Renting in Dubai: cheques, Ejari and the RERA index

Dubai rents in advance: the legal standard is a year's rent in at most four instalments up front, in practice cheques. Against that stand two protections newcomers rarely know: the compulsory Ejari registration that activates your tenancy rights, and the RERA index that reins in rent increases. Plus the items that come on top of the rent — from housing fee to DEWA deposit.

The first tenancy contract in Dubai is a cold shower for many Dutch people — not because of the price per month, but because of the moment at which everything wants to be paid. Whoever knows the system negotiates better and walks into no trap at all.

Paying in advance is the law, cheques are the practice

The Dubai tenancy law is clear about it: if nothing else has been agreed, the annual rent is paid in advance in at most four equal instalments. In practice you hand over post-dated cheques for the whole year on signing — one cheque often earns a discount, four is customary, more is a favour. Those cheques are no formality: a cheque without cover is directly enforceable before the execution judge and in serious cases still a criminal offence. So write them as contracts, because that's what they are.

Ejari: without registration you don't exist

Every tenancy contract has to be registered in Ejari, the system of the regulator RERA — AED 177.75 via the app, AED 220 via an office. This is no bureaucratic frill: without Ejari, courts and government services won't take up your tenancy dispute, and you can't arrange a DEWA connection, a school enrolment or a family visa at that address. First rule of renting in Dubai: no Ejari, no signature.

The RERA index: your protection on renewal

The rent increase on renewal isn't free. The RERA rent index determines the market average per neighbourhood, and the law ties steps to it: if your rent is less than 10% below that average, nothing may be added; above that rising to a maximum of 20%. And every change has to be announced ninety days before the end of the contract — otherwise it doesn't apply. Check the index (free, online) before every renewal; it's the strongest card a tenant has here.

What comes on top of the rent

Besides the bare annual rent, count on: the deposit (negotiable, usually around 5%), agent's commission of up to 5%, the housing fee of 5% of the annual rent that Dubai Municipality collects via your electricity bill, and the DEWA deposit of AED 2,000 (apartment) or AED 4,000 (villa). All together the entry is easily one and a half times the annual rent — the biggest cost item of your whole emigration, and the reason every Dubai budget starts with the home.

The order that works

First choose the neighbourhood by school and work, then get to know the RERA index of that neighbourhood, only then view. Never sign without an Ejari appointment, never hand over more cheques than agreed, and document the condition on handover — the deposit comes back by law, but only whoever can prove what was already broken actually sees it.
