Renting in Czechia: three months' deposit, and the fixed-term contract you can't simply cancel

A Czech landlord may ask at most three months' rent as a deposit, and must return it within thirty days of the end. The pitfall is in the fixed-term contract: as a tenant you can only terminate it if your circumstances change substantially. And the owner who signs must be the same as in the land register, or the contract won't count as proof of accommodation.

Renting in Czechia is not complicated for an EU citizen, and the law protects the tenant well. The deposit, the jistota or kauce, together with any contractual penalty may not exceed three months' basic rent, and the landlord must settle and return it within thirty days of the end. The pitfall is in the term. With a contract for an indefinite period you as tenant may give notice at any time, without a reason. With a fixed-term contract you can't: then you can only leave if your circumstances change substantially. Whoever signs for a year "to have a look first" is in principle tied to it for a year.

What may be in the contract, and what not?

The rental contract should be in writing. The Ministry for Regional Development lists what belongs in it: who the parties are, which home with which furnishings, the term, the rent and the payment date, the services and the advance payments, who pays the energy, the deposit and how it comes back, and the rules for giving notice.

Some clauses are void, even if you sign them. The ministry gives as examples a duty to report visitors, a ban on pets, or the requirement that the landlord consents to living with your partner.

What does renting cost besides the rent?

Service charges are water, heating, waste, lifts and the like. Electricity and gas you preferably put in your own name; the ministry recommends it, and the transfer takes about two weeks if you stay with the same supplier. At the handover of the keys, draw up a handover protocol with the meter readings and the condition of the home.

How do you get out of a contract again?

A fixed-term contract is not a trial period. With an indefinite term, as a tenant you give notice whenever you want. With a fixed term only if your circumstances change substantially, so that you can't reasonably stay, such as a new job elsewhere or a home of your own. And watch the end: if you keep living there for three months after the end date without the landlord asking you to leave, the contract is renewed for the same term, at most two years.

Notice must be in writing, and demonstrably delivered: an ordinary e-mail or text message without a recognised electronic signature doesn't count. The notice period starts on the first day of the month after receipt. If you send it by registered post from abroad, it counts as delivered on the fifteenth working day after sending.

The landlord can only give notice for reasons the law lists, usually with three months' notice, and always stating the reason. A new owner takes over the contract on the same terms; sale of the home is no reason to give notice.

Why does the owner's name count?

For the registration certificate you supply proof of accommodation, and your rental contract is the usual proof for that. But the Ministry of the Interior sets requirements: the document showing your right to the home must be signed by the person listed as owner in the public land register, and the home must have a house number and be designated for residence, lodging or recreation. If you rent from someone who is a tenant themselves, you also supply the document showing their right, such as their own rental contract.

A reassurance: for an EU citizen's registration certificate an owner's statement doesn't need to be officially certified, unlike for the permits for citizens from outside the EU.
